INFORMATION CLAUSE

On the basis of Articles 13 and 14 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), the following information is provided.

1. Data Controller

We will process your personal data:

  • in order to conclude and perform a contract, based on your interest in our offer and the contract concluded (basis: Article 6(1)(b) GDPR);
  • for archival (evidentiary) purposes, as part of our legitimate interest in securing information in case there is a legal need to demonstrate facts (basis: Article 6(1)(f) GDPR);
  • in order to possibly establish, pursue or defend against claims, as part of our legitimate interest in this regard (basis: Article 6(1)(f) GDPR).

3. Storage period of personal data

  • We will store your personal data for the duration of the contract.
  • The processing of your personal data depends on the legal basis that constitutes the lawful ground for our processing of personal data.
  • We process your personal data for no longer than necessary for the purpose of processing.
  • If the legal basis for processing your personal data is consent, the data may be processed until that consent is withdrawn. After withdrawal, data will still be stored for a period corresponding to the statute of limitations for claims that the Controller may assert, or that may be asserted against the Controller.
  • If the legal basis is the performance of a contract, data may be processed as long as necessary to perform the contract, and thereafter for a period corresponding to the statute of limitations for claims that the Controller may assert, or that may be asserted against the Controller.
  • We store your personal data for the period required to fulfill obligations arising from the law, in particular tax and accounting obligations.
  • We store your personal data for accountability purposes, i.e., demonstrating compliance with data protection regulations, for as long as we are obliged to retain the data or documents containing them, in order to document compliance with legal requirements and enable public authorities to verify such compliance.

4. Data recipients

We will transfer your data:

  • for the purpose of accounting for the concluded contract – to our accountant;
  • if you choose service providers who will provide services directly to you in connection with the wedding ceremony and reception – to those service providers.

You have the following rights in relation to the processing of personal data:

  • the right to withdraw consent to processing;
  • the right of access to personal data;
  • the right to request rectification of personal data;
  • the right to request erasure of personal data;
  • the right to request restriction of processing;
  • the right to object to processing;
  • the right to data portability, i.e., the right to receive from us personal data in a structured, commonly used, machine-readable format. You may transmit this data to another data controller or request that we transmit it to another controller. We will only do so if technically feasible. The right to data portability applies only to data we process based on a contract with you or your consent. To exercise the above rights, please contact us. 6. Right to lodge a complaint with an authority

In accordance with Article 77 of Regulation (EU) 2016/679, you have the right to lodge a complaint against the Data Controller with the supervisory authority (the President of the Personal Data Protection Office) if you believe that the processing of personal data violates the Regulation.

7. Right to judicial protection

In accordance with Article 79 of Regulation (EU) 2016/679, you also have the right to an effective judicial remedy if you consider that your rights under the Regulation have been infringed as a result of the processing of personal data in violation of the Regulation.

8. Requirement/voluntariness of providing data

Providing personal data is voluntary and depends on your consent, but it is necessary to conclude a contract. Lack of consent to the processing of personal data will make it impossible to conclude the contract.

9. Transfer of data to third countries or international organizations

We do not transfer your data outside of Poland and the EU / European Economic Area.

10. Automated decision-making

Based on your personal data, the Controller will not make automated decisions regarding you, including decisions resulting from profiling.
